English translation provided for information only. The French version of these terms prevails.
1. Purpose
These terms and conditions govern the individual coaching services and group workshops offered by Clément Marceau, sole trader (the “Provider”), to any natural or legal person (the “Client”). Any booking or order implies full acceptance of these terms.
2. Services and prices
Prices are in euros, all taxes included. VAT not applicable, article 293 B of the French General Tax Code.
- Discovery call: 30 minutes by video, free and with no commitment.
- Rise: 3-month individual programme, 6 one-hour sessions. €720 online. An intensive option (12 sessions over 3 months, one a week) may be offered at the start; its price is given during the prior call with the Provider.
- Solar: 6-month individual programme, 12 one-hour sessions. €1,320 online.
- Soma: 12-month programme for professionals in the impact sector and the social and solidarity economy. In preparation; its terms will be specified when it opens.
- Monthly subscription: €220 per month, unlimited 45 to 55-minute sessions, up to 2 sessions per week. Reserved for Clients who have already had at least one session with the Provider. Each session leads to a piece of work the Client commits to; a new session can only be booked once this work has been done.
- Narrative Breathwork workshops: €50 per workshop; €35 solidarity rate (2 places per workshop, no proof required).
In-person sessions: individual sessions take place online or, on request, in person in Paris. Each in-person session carries a €20 supplement for the room rental.
Included workshops: paying for Rise in one instalment includes one place in a group Narrative Breathwork workshop; Solar includes two places. These places are personal, non-refundable and must be used during the programme, subject to availability.
3. Booking and orders
Individual programmes and subscription: the Client books a discovery call via the booking link on the website. The format is chosen during a video call with the Provider. The programme is confirmed by written acceptance (by email) of the Provider’s proposal, followed by payment as set out in section 4.
Group workshops: booking and payment are made online via the Billetweb platform; the place is confirmed upon payment. Billetweb’s terms of use apply to the online payment.
4. Payment and invoicing
Individual programmes and the subscription are paid by bank transfer. Rise and Solar can be paid in one, two or three instalments, according to the schedule agreed with the Provider. The monthly subscription is paid each month, before the start of the period concerned.
An invoice is issued for each payment and sent by email.
5. First-session guarantee
If, after the first session of an individual programme (Rise or Solar), the Client feels it really doesn’t suit them, they may ask to stop the programme and be refunded the amount paid, minus the cost of this first session, i.e. €120 (€140 if it took place in person).
This guarantee only applies to payment in one instalment. The request must be made in writing to contact@clementmarceau.com, within 7 days of the first session and before the second one. The refund is made within 14 days of the request.
This guarantee is a commercial commitment. It is not a guarantee of results and does not limit the Client’s legal rights, in particular the right of withdrawal.
6. Right of withdrawal
A Client acting as a consumer has 14 calendar days from the conclusion of the contract to withdraw, without giving any reason, by notifying their decision clearly in writing (for example by email to contact@clementmarceau.com).
If the Client expressly asks for the services to start before the end of this period (for example by booking a session within the 14 days), they will pay, in the event of withdrawal, an amount proportional to the services already provided. The right of withdrawal does not apply to services fully performed before the end of the period with the Client’s agreement.
Sums due are refunded within 14 days of receiving the decision, using the same means of payment, unless otherwise agreed.
7. Cancellation and rescheduling
Individual sessions: any session can be cancelled or rescheduled free of charge up to 48 hours before the scheduled time. A session cancelled less than 48 hours before, or missed, is considered due and deducted from the programme, except in cases of force majeure.
Group workshops: free cancellation until the day before the workshop. On the day, or in case of absence, 50% of the price is retained.
By the Provider: if the Provider is unable to attend, a new date is offered as soon as possible. If no slot suits, the Client may ask for a refund of the session or workshop concerned.
8. Conduct of sessions and confidentiality
Individual sessions take place online (link sent before the session) or in person in Paris. Workshops take place at the venue shown on the workshop page.
The Provider is bound by strict confidentiality regarding the content of sessions. No session content is shared with a third party without the Client’s written consent.
9. Specific conditions for breathwork workshops
Conscious breathing is an intense practice. Before booking, the Client reads the contraindications listed on the workshop page and undertakes to inform the Provider of any relevant health condition, including pregnancy. In the case of a relative contraindication, medical advice may be requested before participating.
During the workshop, participants are free to stop the exercise at any time and undertake to tell the facilitator if they feel the need for assistance.
10. Liability
Somatic coaching and breathwork are neither medical treatment nor psychotherapy, and do not replace medical, psychological or psychiatric care. The Provider is not a health professional.
The Provider has an obligation of means and cannot guarantee any particular result. The Client remains responsible for their choices and for applying the practices offered. The Provider cannot be held liable in cases of force majeure (article 1218 of the French Civil Code).
11. Intellectual property
Materials given to the Client (documents, recordings, exercises) remain the exclusive property of the Provider. They are for personal use only; any reproduction, distribution or sale without prior written consent is prohibited.
12. Personal data
The Client’s personal data is used only to manage the relationship and invoicing, and is never sold. Its processing is detailed in the privacy policy. The Client may exercise their rights by writing to contact@clementmarceau.com.
13. Complaints and mediation
In the event of a complaint, the Client first contacts the Provider at contact@clementmarceau.com to seek an amicable solution.
In accordance with article L612-1 of the French Consumer Code, consumer Clients may use a consumer mediator free of charge. The details of the competent mediator will be given here.
14. Governing law
These terms are governed by French law. Failing an amicable agreement, disputes fall under the competent French courts; for consumer Clients, the court of the place where they lived when the contract was concluded or the harmful event occurred.
15. Changes to these terms
These terms may change. The applicable version is the one in force at the time of booking or ordering.
